Mortgage Deed and Mortgage Redemption Documents in Gurugram

Taking a loan against property, or just repaid one?

Updated

When property is used as security for a loan, the lender's charge is created by a mortgage deed or by depositing the title deeds. When the loan is repaid, the charge has to be released and the original documents returned. GurugramHelp assists with the documentation at both ends.

What should I collect when I repay a home loan?

Ask the lender for the loan closure certificate and no-dues letter, every original property document they hold, and a release of the mortgage, registered where the original mortgage was registered. Then check that the charge has been cleared from every record where it was noted.

Creating a mortgage

Home loans are usually secured by depositing the title deeds with the lender, sometimes recorded in a memorandum, while other loans use a registered mortgage deed. Lenders also record their security interest with CERSAI.

When the loan is closed

  • Loan closure or no-dues certificate
  • All original title documents, checked against the lender's list
  • A release or reconveyance deed, registered where needed
  • Confirmation that the CERSAI charge is satisfied
  • A letter to the society or authority, if a charge was noted with them

Getting your documents back

The Reserve Bank of India requires regulated lenders to return original property documents within 30 days of full repayment, with compensation for delays caused by the lender. If a document can't be returned, ask for a written acknowledgement and certified copies, because buyers and banks will ask for the full chain later.

Common questions

How long can the bank take to return my documents?

Under RBI's rules for regulated lenders, original property documents should be returned within 30 days of full repayment, with compensation for delays caused by the lender.

Do I need a release deed if the loan was by deposit of title deeds?

Often the lender returns the documents with a no-dues certificate, but where a mortgage was registered, a registered release is advisable so the record shows the charge has gone.

Can I sell a property that's still mortgaged?

Yes, but the lender's dues have to be cleared, usually from the sale proceeds, and the release arranged as part of the transaction.
