Before assets can move to the family, banks, registries and authorities need proof of who the heirs are. Depending on the asset and whether there's a will, that can mean a legal-heir certificate, a succession certificate, probate, or a family settlement with affidavits. GurugramHelp assists families with the documentation.
What's the difference between a legal-heir certificate and a succession certificate?
A legal-heir certificate identifies the heirs of the person who died and is often used for pensions, utilities and records. A succession certificate is granted by a civil court and authorises the holder to collect debts and securities, such as bank deposits and shares, that belonged to the deceased.
Which document does each asset need?
- Bank accounts and deposits: the bank's claim process, the nomination, or a succession certificate
- Shares and securities: transmission with the company or depository, sometimes needing a succession certificate or probate
- Property: mutation with heir documents, and registered release deeds if heirs consolidate shares
- Vehicles: transfer on death with Form 31
- Pensions and utilities: usually a legal-heir or surviving-member certificate
A nominee is not the same as an heir
A nominee on a bank account or policy receives the money, but holds it for the legal heirs. Nomination makes the claim simpler; it doesn't decide who ultimately inherits.
When there is a will
A will can make things clearer, but some institutions ask for probate before acting on it. Whether probate is needed depends on where the will was made and the property it covers.
How GurugramHelp helps
We list the assets with you, work out which document each needs, and prepare the affidavits, applications and settlement documents. Court petitions, such as for a succession certificate or probate, are filed by an advocate.
Common questions
Do all the legal heirs need to agree?
Things move fastest when they do. Where heirs disagree, institutions may wait for a court order, and the matter may need legal proceedings.
Is a family settlement legally valid?
A family settlement among heirs is recognised, but if it transfers rights in immovable property it generally needs to be stamped and registered to be relied on. The wording matters.
Can heir documents be used to transfer a vehicle?
Yes. They support the Form 31 transfer of a vehicle after the owner's death.
