Ownership doesn't move to the family automatically. The person succeeding to the vehicle applies to the registering authority to have the registration transferred to them. GurugramHelp assists families with this paperwork, including the legal-heir documents it depends on.
How is a vehicle transferred after the owner dies?
The successor applies with Form 31, the death certificate and documents showing their entitlement, such as a legal-heir certificate or succession papers, along with consent from the other heirs where there are several. The registering authority then records the new owner.
Who applies
The application is made by the person who succeeds to the vehicle. Where there are several legal heirs, the others usually give their consent or a no-objection so that one heir can take over the registration.
Documents commonly involved
- Form 31
- Original RC
- Death certificate of the registered owner
- Legal-heir certificate, succession certificate, will or family settlement, as applicable
- Consent or no-objection affidavits from the other heirs
- Applicant's ID and address proof
- Valid insurance and PUC certificate
Don't let it drift
The Motor Vehicles Act sets time limits for informing the registering authority after an owner's death and for applying for the transfer. Insurance is tied to the registered owner too, so a vehicle left in a deceased person's name can cause trouble with claims.
When the heir papers are the hard part
Most delays come from the heir documents rather than the vehicle. If the family doesn't yet have a legal-heir or succession document, that has to be sorted first, and it usually helps with the family's other assets as well.
How GurugramHelp helps
We review the documents the family has, identify what's missing, prepare the affidavits and the application, and assist with the RTO formalities.
Common questions
Can the vehicle be sold without first moving it into an heir's name?
In most cases the registration is first moved to the successor, who then sells it as the owner. Check your situation before you agree a sale.
What if the vehicle still has a loan?
The financier's position has to be addressed: the loan may need to be settled, or the financier's consent obtained, before the transfer is completed.
Do all the heirs need to sign?
Where there are several legal heirs, the others commonly provide consent or a no-objection. The exact requirement depends on the documents the family holds.
